1. Scope of Application

These General Terms and Conditions (hereinafter referred to as "GTC") apply to all orders and purchases made via the aforementioned webshop and websites. By using the webshop, the websites, or by placing an order, you agree to be bound by these GTC.

DynaTag AG reserves the right to amend these GTC at any time. Changes become effective upon publication on the webshop or websites. The version applicable at the time of the order or use shall be decisive.

2. Offers and Products

Our range of products includes, in particular, secure marking solutions, SOS and retrieval systems, accessories, and cloud-based identity services.

All offers are valid as long as they are visible in the webshop or on the websites and/or while stocks last. Product range and prices are subject to change. Product images are for illustrative purposes and may differ from the delivered product. Wherever possible, product photos are original photographs. Illustrative images showing product applications may have been created using AI services.

3. Conclusion of Contract and Ordering

A contract between you and DynaTag is concluded upon confirmation of the order. By clicking the "Place binding order" button, you submit a legally binding order.

The receipt of your order will be confirmed by email. Delivery will only take place after full payment has been received. DynaTag reserves the right to cancel orders in the event of suspected fraud or pricing errors.

4. Prices and Terms of Payment

The prices listed at the time of the order shall apply. All prices are stated in Swiss Francs (CHF) or Euros (€) and include 8.1% Swiss value-added tax (VAT). For deliveries outside of Switzerland, additional fees, shipping costs, and the respective local VAT may apply.

Accepted payment methods:

Any transaction costs shall be borne by the customer. Refunds are always issued to the payment method used for the original purchase.

5. Shipping and Delivery

The delivery period begins upon receipt of payment and ends when the goods are prepared for shipment. The shipping method can be selected in the webshop. Benefit and risk transfer to the customer upon handover to the shipping service provider.

6. Returns and Right of Withdrawal

You have the right to withdraw from the contract within 30 days of receiving the goods. This is subject to the condition that the goods are unused, undamaged, and in their original packaging.

• Return shipping costs are borne by the customer, except in the case of incorrectly delivered or defective goods.
• Refunds will be processed within 14 business days after receipt of the returned goods.

7. Warranty

DynaTag grants a 24-month warranty on material and manufacturing defects. The warranty excludes damage caused by improper use, normal wear and tear, or modifications made by the customer.

8. Customer Accounts and Responsibility

If you create a customer account, you are responsible for maintaining its confidentiality. DynaTag is authorized to suspend or delete accounts in the event of violations of these GTC or misuse. You can update or delete your information in your customer account at any time.

9. Intellectual Property

All content, trademarks, logos, product designs, and software are the property of DynaTag AG or its licensors. Any use, reproduction, or distribution without prior written consent is prohibited.

10. Acceptable Use

You agree not to use the platforms for any unlawful or abusive purposes. In particular, the following is prohibited:

• Distribution of illegal content
• Compromising the security or availability of the webshop or DynaTag platforms
• Imitation or unauthorized use of DynaTag's trademarks and content

11. Data Protection

The applicable Privacy Policy can be viewed at any time on the webshop or websites.

12. Liability

DynaTag is not liable for interruptions, technical problems, or unavailability of the platforms, for delivery delays or failures caused by third parties, or for indirect, incidental, or consequential damages. To the extent permitted by law, liability is limited to the purchase price of the respective product or service.

13. Force Majeure

DynaTag is not liable for delays or non-performance resulting from events beyond our control (e.g., natural disasters, war, strikes, government orders, or technical failures).

14. Indemnification

The customer agrees to indemnify and hold harmless DynaTag, its employees, and partners from any third-party claims arising out of abusive or unlawful use of the platforms.

15. Severability Clause

Should individual provisions of these GTC be invalid, the remaining provisions shall remain unaffected.

16. Entire Agreement

These GTC, along with the Privacy Policy and other published policies (e.g., return or shipping policies), constitute the entire agreement between you and DynaTag.

17. Applicable Law and Place of Jurisdiction

Swiss law shall apply exclusively. The place of jurisdiction is Zurich, Switzerland.
