1. Scope

These Terms and Conditions (hereinafter "T&C") apply to all orders and purchases made through the webshop and websites mentioned above. By using the webshop, the websites or by placing an order, you agree to these T&C.

DynaTag AG reserves the right to amend the T&C at any time. Changes take effect upon publication on the webshop or websites. The version valid at the time of the order or use shall apply.

2. Offer and Products

Our offer includes secure marking solutions, SOS and recovery systems, accessories and cloud-based identity services.

All offers are valid as long as they are visible in the webshop or on the websites and/or while stocks last. Prices and product ranges may change at any time. Images are for illustration purposes and may differ from the delivered product. Product images are, wherever possible, original photographs. Illustrative images with application examples may have been created using AI services.

3. Contract Conclusion and Orders

A contract between you and DynaTag is concluded upon confirmation of the order. By clicking the button “order with obligation to pay” you place a binding order.

You will receive confirmation of your order by e-mail. Delivery will only take place after full payment has been received. DynaTag reserves the right to cancel orders in cases of suspected fraud or pricing errors.

4. Prices and Payment Terms

The prices listed at the time of ordering shall apply. All prices are stated in Swiss Francs (CHF) or in Euros (€), including 8.1% Swiss VAT. For deliveries outside Switzerland, additional fees, shipping costs and the applicable VAT may apply.

Accepted payment methods:

• Prepayment / Bank transfer
• Credit cards (Stripe)
• TWINT
• PayPal

Any transaction fees are borne by the customer. Refunds are always made to the payment method used for the purchase.

5. Shipping and Delivery

The delivery period begins upon receipt of payment and ends with the provision of the goods for shipment. The shipping method can be selected in the webshop. Risk and benefit are transferred to the customer once the goods are handed over to the shipping service provider.

6. Returns and Right of Withdrawal

You have the right to withdraw from the contract within 30 days of receiving the goods. The condition is that the goods are unused, undamaged and in the original packaging.

• Return costs are borne by the customer, unless the goods are defective or incorrectly delivered.
• Refunds are made within 14 working days of receipt of the returned goods.

7. Warranty

DynaTag grants a 24-month warranty on material and manufacturing defects. Damage caused by improper use, normal wear and tear or customer intervention is excluded from the warranty.

8. Customer Accounts and Responsibility

If you create a customer account, you are responsible for maintaining its confidentiality. DynaTag is entitled to block or delete accounts in the event of violations of these T&C or misuse. You can adjust or delete your details in the customer account at any time.

9. Intellectual Property

All content, trademarks, logos, product designs and software are the property of DynaTag AG or its licensors. Any use, reproduction or distribution without written consent is prohibited.

10. Permitted Use

You agree not to use the platforms for unlawful or abusive purposes. In particular, the following is prohibited:

• Dissemination of unlawful content
• Impairment of the security or availability of the webshop or the DynaTag platforms
• Imitation or unauthorised use of DynaTag trademarks and content

11. Privacy

The applicable Privacy Policy is available at any time on the webshop or websites.

12. Liability

DynaTag accepts no liability for interruptions, technical problems or unavailability of the platforms, for delivery delays or failures caused by third parties, or for indirect, incidental or consequential damages. Liability is – to the extent permitted by law – limited to the purchase price of the respective product or service.

13. Force Majeure

DynaTag is not liable for delays or non-performance caused by circumstances beyond our control (e.g. natural disasters, war, strikes, government orders or technical failures).

14. Indemnity

The customer undertakes to indemnify DynaTag and its employees and partners against any claims by third parties arising from abusive or unlawful use of the platforms.

15. Severability Clause

Should individual provisions of these T&C be invalid, the remaining provisions shall remain unaffected.

16. Entire Agreement

These T&C together with the Privacy Policy and other published policies (e.g. Returns or Shipping Policy) constitute the entire agreement between you and DynaTag.

17. Applicable Law and Jurisdiction

Exclusively Swiss law applies. Place of jurisdiction is Zurich, Switzerland.
