
General Terms and Conditions
for shop.dynatag.ch webshop
The web shops shop.dynatag.ch, shop.dynatag.com, the Thync.it- and DynaTag platforms and the websites www.dynatag.ch and www.dynatag.com are operated and managed by DynaTag AG.
1. Scope
These general terms and conditions (hereinafter referred to as "GTC") apply to all orders and purchases of DynaTag and Thync.it articles, services and services as well as DynaTag partner articles and their services and services (hereinafter referred to as "products") made via the web shop https://shop.dynatag.ch (hereinafter referred to as "web shop").
DynaTag AG reserves the right to change the GTC at any time. Changes will be made available on the web shops and will take effect upon their publication. The version of the GTC valid at the time of use is decisive for the contractual relationship.
2. Offer, conclusion of contract and delivery of goods
2.1 Offer
The offer for Thync items and DynaTag items is valid as long as it is visible in the web shops and/or stocks last. Price and range changes are possible at any time. The images shown in advertisements or in the web shop are for illustration purposes and may differ from the products actually delivered.
2.2 Conclusion of contract
The contract is concluded when DynaTag confirms the order. You agree to these terms and conditions by ordering goods in the web shops.
2.3 Order
By clicking the button "order with payment" you place a binding order for the items in your shopping cart. Receipt of your order will be confirmed by email. The ordered goods will be delivered to the delivery address specified in the web shop upon receipt of full payment of the purchase price plus any shipping and processing costs (hereinafter "invoice amount"). The invoice amount is due upon conclusion of the contract and is payable within 7 days. If payment is not made within 7 days of receipt of the order, the order will be automatically canceled in the web shop. DynaTag is free to reject an order in whole or in part without giving reasons. In this case you will be informed and any payments already made will be refunded.
2.4 Delivery of goods
The delivery period is the period between receipt of payment of the invoice amount and the goods being made available for dispatch. The customer can choose the shipping method in the web shop. Benefit and risk are transferred to the customer at the time of dispatch at DynaTag's headquarters. DynaTag is entitled to make partial deliveries. Any written agreements to the contrary between the parties remain reserved. Benefit and risk of the products are transferred to the customer as soon as the products have been handed over to the person or institution carrying out the transport.
3. Prices and shipping costs
3.1 Prices
The prices listed in the offer at the time of ordering apply. Unless otherwise stated, prices are in Swiss francs (CHF), including value added tax (VAT).
The shipping costs are automatically calculated for the selected shipping method during the ordering process and displayed separately.
3.2 Payment options
Payments can be made via advance payment/bank transfer, credit card (Stripe) and PayPal. For each order, we reserve the right not to offer certain payment methods and to refer to other payment methods. Payments from bank accounts in Switzerland and the European Union (EU) are accepted. Any costs of a money transaction are to be borne by the customer. In the case of a purchase by credit card, your credit card account will be debited by us when the order is placed.
Invoices, credit notes and reminders are issued electronically. If you would like a paper invoice or credit note, this is subject to a fee. We also reserve the right to charge a reminder fee for reminders.
3.3 Refunds
Any refunds in advance will be made to the account you specified for the refund. If you pay via PayPal or credit card, the refund will be made to the associated PayPal or credit card account. If a gift voucher was redeemed during the purchase, the corresponding amount will be credited to your gift voucher account. If you exercise your right of cancellation, any amounts already paid will be refunded to the account you specified for the refund within 14 days of receipt of the cancellation.
Unfortunately, shipping costs cannot be refunded.
4. Vouchers
4.1 Promotional vouchers
Promotional vouchers are vouchers that we issue as part of advertising campaigns or special offers with a specific period of validity. They are not for sale. Promotional vouchers can be redeemed once during the specified period as part of an order process and can be tied to a minimum order value. Individual products can be excluded from the voucher campaign. Promotional vouchers cannot be used to purchase gift vouchers. The value of the goods must be at least the amount of the promotional voucher. The promotional voucher will not be refunded if goods are returned in whole or in part. Promotional vouchers can only be redeemed before the order process is completed. The promotional voucher cannot be transferred to third parties and multiple promotional vouchers cannot be accumulated. If you used a promotional voucher to make your purchase, we reserve the right to charge you the original price of the goods you keep if - due to your return - the total value of the order falls below the respective value of the promotional voucher.
4.2 Gift vouchers
Gift vouchers are cash vouchers for the purchase of Thync items and DynaTag partner items. Gift vouchers or remaining credit must be redeemed before completing the order process. The gift voucher or remaining credit will not be paid out in cash.
5. Right of withdrawal
You have the right to withdraw from the contract without giving reasons within 30 calendar days of receiving the goods, provided that the products ordered are not products specially made for you (e.g. with your logo). To meet the cancellation deadline, it is sufficient to send the cancellation in writing before the deadline expires. However, the prerequisite for exercising the right of cancellation is that you have neither used nor activated the products and that you return the products complete and undamaged in their original packaging. To return the goods, please use the return form that can be printed out in your customer account at shop.dynatag.ch or shop.dynatag.com.
The products must be sent with sufficient postage to the following address: DynaTag AG, c/o Beerli, Chilerai 42a, 8602 Wangen b. Dübendorf, Switzerland. Note: RETURN.
6. Warranty
DynaTag provides its services carefully and professionally, unless DynaTag is prevented from doing so by circumstances beyond its control.
DynaTag guarantees that the products are free from material or manufacturing defects and correspond to the guaranteed properties for a period of 12 months from receipt by the buyer. The prerequisite for asserting warranty claims is that you inspect the products upon receipt and immediately report any defects found in writing. This also applies to hidden defects. DynaTag can provide the warranty either by partial or complete replacement with an equivalent product, credit up to a maximum of the sales price at the time of the order or reduction.
7. Responsibility for content
You are liable for the manner in which you use the products and services, in particular for your own content. You agree not to upload or share any illegal files or content in connection with the use of the products. In particular, privacy must be protected. The files can be checked by the cloud provider during upload and deleted if necessary. There is no right to unlimited data storage. DynaTag also reserves the right to delete illegal or inappropriate content from the servers (and backup servers) immediately and without prior notice at any time. DynaTag also reserves the right to delete registered customers including their files, to limit their access or to block their member account in the event of a violation of these terms and conditions.
8. Data protection
DynaTag's privacy policy can be found on the webshops' websites or at https://shop.dynatag.ch. It forms an integral part of these terms and conditions and the contract between DynaTag and the customer.
9. Liability
DynaTag is not liable for the accuracy, completeness, adequacy or legality of data, files, content and information processed on the Thync.it or DynaTag platform.
DynaTag is not liable for the uninterrupted and unrestricted availability of the Thync.it or DynaTag platform.
Except in the exceptions required by law, the liability of DynaTag, its subcontractors, assistants or suppliers is excluded for indirect, indirect or consequential damages such as damages due to downtime, loss of profits, unrealized profits or savings, loss of use, loss of earnings or production, additional expenses, costs and compensation for the procurement of replacement products or services by the customer, as well as compensation for the loss or recovery of data.
10. Applicable law and place of jurisdiction
The contractual relationships between the parties are subject exclusively to Swiss law, excluding the conflict of laws rules and the "Vienna Sales Convention" (United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980).
The courts at the registered office of DynaTag or at the consumer's place of residence are responsible for judging disputes arising from this contract. If you are a consumer, you can choose to appeal to the courts at your own place of residence or at the registered office of DynaTag.
